Our lawyers said we have to include all this legal information.  Please call if you have any questions and we would be happy to assist you.  Most of our customers are institutional Buyers, purchasing for schools and universities, hotels, churches, and businesses, which mean they understand shipping terms, Financial terms and restocking fees.  Please contact your sales rep if you have questions about anything that is unclear after reading this.

1  Acceptance The Use Of Trident Furniture Group, Inc. Terms and Conditions

1.1 Your access to and use of Trident Furniture Group, Inc. is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

3  Advice and Returns/Restocking Fees

3.1 No one wants to order the wrong thing, so we make every attempt before an item ships, that it is what you want to purchase.   The contents of Trident Furniture Group, Inc. website do not constitute advice and should not be relied upon in making or refraining from making, any decision.  Some product photos are for illustrative purposes only.  As a customer,  you need to read the specifications and determine if the product is suitable for your specific needs.   Trident will generally not ship items unless we make contact to confirm the product selection.  However, Trident is not responsible for purchases you make that don't fit, have the wrong color, wrong size, don’t match, etc.  We will do all we can to avoid a problem but the responsibility is ultimately upon you the buyer.  In the rare case a return is required, we reserve the right to charge a 15-35% restocking fee.  Some custom items can not be cancelled after order is  confirmed and can not be returned.   All returns are returned freight pre-paid. Freight damaged goods or freight loss are treated as described below in section 11.

4  Change of Use

Trident Furniture Group, Inc. reserves the right to:
4.1  change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that Trident Furniture Group, Inc. shall not be liable to you for any such change or removal and.
4.2  change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

5  Links to Third Party Websites

Trident Furniture Group, Inc. Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

6.1  All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to Trident Furniture Group, Inc. or otherwise used by Trident Furniture Group, Inc. as permitted by law.

7.4  Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Trident Furniture Group, Inc. for death or personal injury as a result of the negligence of Trident Furniture Group, Inc. or that of its employees or agents.

8  Indemnity

8.1 You agree to indemnify and hold Trident Furniture Group, Inc. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Trident Furniture Group, Inc. arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

9  Severance

9.1 If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

10  Governing Law

10.1 These Terms and Conditions shall be governed by and construed in accordance with the law of USA and you hereby submit to the exclusive jurisdiction of the Utah,  USA courts.

11. Shipping, Lead Times, Freight Damage, Order Cancellations, and Special Services

11.1 All items have different lead times.  Standard lead times can be between 2 days and 4 weeks. All orders, including freight details, are confirmed before payment is accepted, so please inquire and alert your sales rep of any time sensitive orders.  Some items are custom made and extend lead times.  Trident Furniture cannot be responsible for manufacturing delays or delays in shipping beyond their control.  Standard shipping is FOB Factory Or FOB origin via common carrier with tailgate delivery.  If you need that explained, please ask your sales rep.  

11.2 Other freight or delivery services require advance confirmation and payment via quote.   Inside delivery means items are offloaded and taken inside the main delivery address.  Breaking pallets down, removing pallets and packing materials are seperate services. White glove service, where items are moved withing a building, unpacked and dunnage removal are arranged by quote only, before shipment.   Any special services that the consingee has the delivery company do, where there is a charge,  will be paid by the consignee (customer). 

11.3  Redelivery fees when an appointment is missed will be charged and paid by the consignee.  Delays which accure storage fees will be paid by the consignee.  Freight companies charge to hold freight.

11.4 Inspection and Damage:  When items are delivered, the customer must carefully inspect the packaging and contents and note any damage, however minor, on the shippers paperwork when they sign for the shipment.  Customer agrees not to refuse an order without written approval and alert Trident immediately of freight damage.  If there are no notes on the delivery paperwork, freight claims are much more difficult, if not impossible to process and may be denied. Trident instructs all buyers (customers)  with instructions before delivery on this issue so you are educated and know what to do in the event of a problem or damaged delivery.  Customers are responsible to report damage or loss in a timely matter.  If after 60 days of purchase and or payment, no shipping damage or claim or loss is reported, the sale and shipment is considered complete and final.

USA. Sales tax required by law may be applied to certain sales.  Details will be provided before sales are finalized.  Buyers are responsible for their local sales tax.   Please call if you have questions. 

13. Pricing Changes and Errors

Prices change and are updated regularly as quickly as possible.  Mistakes happen and sometimes corrections must be made.  Should errors be discovered in product pricing before shipment, the customer will be given the opportunity to confirm the new order or cancel prior to shipment.  In no way will Trident be held liable for damages related to an order cancelled prior to shipment.


 14. International: Please call regarding shipments to Canada and other foreign countries. We use our broker to ship to Canada and Mexico.  Other countries are handled individually.
